We have represented numerous produce suppliers and dealers in disputes under the federal Perishable Agricultural Commodities Act (“PACA”) and other such laws. These disputes commonly involve breach of trust and other tort claims against individuals affiliated with the defaulting business.
Additionally, these disputes often involve applications for temporary restraining orders, filed at the inception of the case and without notice to the debtors, to enjoin the debtors’ assets. Such applications are rarely granted in the normal course, but we have never had such an application denied, and the resulting TROs normally lead to quick and efficient resolutions.
